POPI ACT Agreement and Consent Declaration for The Property Expert Profile

AGREEMENT AND CONSENT DECLARATION

This document serves as an Agreement and Consent Declaration between the undersigned individual/entity/body/company, hereinafter referred to as the “Client,” and the Service Provider/Company, collectively referred to as “The Service Provider.”

1. INTERPRETATION

1.1 In this Agreement, the following terms have the meanings specified:

• “This Agreement” refers to the Agreement contained in this document.
• “The Company/Service provider” refers to The Property Expert Profile, including its affiliated, holding, and subsidiary companies.
• “Confidential information” includes, but is not limited to, information related to know-how, business methods, financial models, personal information, and any other information deemed confidential.
• “Personal information” encompasses details as defined in the Protection of Personal Information Act (POPI) adopted by the Republic of South Africa.
• “The effective date” signifies the date of signature of this Agreement.
• “The parties” denote the parties involved in this Agreement.
• “Processing” refers to any operation or activity concerning personal or any information, as outlined in POPI.

2. POPI COMPLIANCE

All parties involved agree to comply with POPI regulations and process information and/or personal data in accordance with these regulations. The processing will be solely for the purpose of providing the services outlined in the agreement.

3. CONFIDENTIAL INFORMATION

The parties acknowledge that confidential information may be classified as private, confidential, or personal. This information may relate to any party involved in the agreement or third parties associated with it. All parties agree that such information may have value and may or may not be in the public domain.

4. IRREVOCABLE AGREEMENT

For the provision of services on behalf of the client, all parties irrevocably agree that “confidential information” includes information marked as such, data and business information, personal information under POPI, and trade secrets related to the client or any third party associated with the agreement.

5. USE OF INFORMATION

By signature, all parties agree that the service provider may use and process all information, personal or otherwise, provided. This use may include placing such information in the public domain. The service provider commits to using best endeavors and taking reasonable precautions to ensure information is used only for its intended purposes.

6. CONSENT

By submitting information, the client consents to the collection, collation, processing, storing, and disclosure of such information in accordance with this policy.

7. ACCEPTANCE

By signing this Agreement and Consent Declaration, all parties acknowledge that they have read, understood, and agreed to be bound by the terms and conditions outlined herein.

8. OPT-OUT

If the client does not agree with the terms and conditions, immediate notification to the service provider is required; otherwise, acceptance will be deemed.

By signing below, the parties confirm their understanding and acceptance of the terms herein.

SHOULD YOU NOT AGREE TO THE TERMS AND CONDITIONS AS SET OUT IN THIS AGREEMENT AND CONSENT DECLARATION, YOU MUST NOTIFY THE SERVICE PROVIDER IMMEDIATELY, FAILING WHICH IT WILL BE DEEMED THAT YOU ACCEPT AND AGREE TO THE TERMS AND CONDITIONS SET OUT ABOVE.
